Regulates the sale, testing, and use of kratom products in Wyoming by establishing labeling requirements, age restrictions, and enforcement mechanisms.

• Defines key terms including kratom leaf, kratom products, adulterated kratom, synthesized and semi-synthesized alkaloids, and other related concepts for purposes of the regulation. (W.S. 35-7-2201)
• Prohibits the sale of kratom products to persons under 21 years of age and requires age verification through photographic identification or electronic scan devices. (W.S. 35-7-2202(a)(i)(B), W.S. 35-7-2202(f))
• Prohibits kratom products that are adulterated, contain synthesized or semi-synthesized alkaloids, exceed 2% 7-hydroxymitragynine in the alkaloid fraction, are confections or candy-like in form, or are combustible or intended for vaporization. (W.S. 35-7-2202(a)(i), W.S. 35-7-2202(a)(iv))
• Requires kratom product labels to display manufacturer/distributor information, full ingredient lists, health warnings (including against use by pregnant or breastfeeding persons and warnings about potential interactions with medications), FDA disclaimer, child safety warning, directions for use, and quantitative alkaloid content per serving. (W.S. 35-7-2202(a)(ii))
• Requires retailers to store and display kratom products in a manner that prevents access by persons under 21 years of age. (W.S. 35-7-2202(a)(iii))
• Establishes misdemeanor penalties of up to one year imprisonment and/or up to $1,000 fine for violations of the act, with potential injunctions against retailers after three violations within two years. (W.S. 35-7-2202(b), W.S. 35-7-2202(d))
• Authorizes the state chemist to analyze kratom products upon request by law enforcement or the Department of Health to verify compliance with adulteration and alkaloid content requirements. (W.S. 35-7-2202(c))
• Designates the Department of Health as the lead agency to ensure compliance and authorizes it to contract with local law enforcement to conduct random inspections at retail locations, including use of persons under 21 years of age with parental consent and specific safeguards.
