Prohibits Wyoming governmental entities from obtaining, using, or contracting for biometric data, geolocation data, and automatic license plate reader systems, with limited exceptions for law enforcement under warrant requirements.

• Establishes definitions for automatic license plate reader systems, biometric data, geolocation data, and related terms, with specific exclusions for photographs, videos, health care information, and genetic data unless subjected to biometric processing. (W.S. 9-30-101)
• Prohibits all governmental entities from obtaining, retaining, or using biometric data to identify persons, geolocation data to track locations, or automatic license plate reader systems to identify vehicles, and prohibits contracting with third parties to perform these activities. (W.S. 9-30-102(a))
• Prohibits governmental entities from purchasing biometric or geolocation data from third parties when such collection would be prohibited or require a warrant, prohibits sharing such data outside jurisdiction without a warrant, and prohibits selling or conveying such data to private entities. (W.S. 9-30-102(b))
• Permits law enforcement agencies to use biometric and geolocation data only for investigating violent felonies with probable cause, assisting in locating or identifying missing or endangered persons, or identifying deceased persons, generally requiring a warrant except in emergencies posing imminent threat of serious harm. • Allows law enforcement to use automatic license plate reader systems only for identifying stolen vehicles, vehicles associated with wanted or missing persons, vehicles registered to persons with outstanding warrants, surveillance in criminal investigations, violent felonies, or vehicles near recent crime scenes, with warrant requirements subject to exceptions for stolen vehicles and emergencies. • Permits the Department of Transportation and law enforcement to use automatic license plate reader systems at ports of entry, weigh stations, and weigh station ramps for commercial vehicle violations, and permits governmental entities to use such systems to regulate parking facilities and enforce parking restrictions.
