AN ACT relating to nicotine products; requiring manufacturers of nicotine products to obtain a license; requiring manufacturers of electronic cigarettes and vapor material to file certifications as specified; placing restrictions on the sale and advertising of electronic cigarettes and vapor material; requiring the department of revenue to publish a directory of electronic cigarettes and vapor material offered for sale in Wyoming by licensed nicotine product manufacturers; prohibiting the sale of nicotine products not included in the directory; requiring biannual inspections of retailers, distributors and wholesalers of electronic cigarettes and vapor material; providing penalties; providing definitions; providing rulemaking; making conforming amendments; and providing for an effective date.

What does this bill do?

Establishes licensing and reporting requirements for manufacturers of nicotine products, particularly electronic cigarettes and vapor material, and restricts their sale and advertising.

Prohibits marketing, advertising, or selling electronic cigarettes or vapor material with cartoon characters, images mimicking youth-targeted products, youth-oriented symbols, or celebrity endorsements aimed at minors. Also prohibits products with entertainment features such as games, music, photos, or video. (W.S. 14-3-311, Sec. 1)
Requires nicotine product manufacturers of electronic cigarettes and vapor material to file a certification with the Department of Revenue before obtaining a manufacturer license, including company information, product lists with nicotine content, federal PACT Act registration, attestations of U.S. manufacturing or importation, FDA warning letter history, and youth access prevention policies. (W.S. 39-18-112, Sec. 1)
Charges manufacturers a one-time nonrefundable fee of one hundred dollars per product type or model for initial inclusion in the product list. (W.S. 39-18-112(c), Sec. 1)
Requires manufacturers to submit changes to product lists within thirty days and provide biannual confirmation that application information remains accurate and submit customs entry forms from the preceding six months. (W.S. 39-18-112(e), Sec. 1)
Requires nonresident manufacturers to appoint and maintain a registered agent for service of process in Wyoming and provide the agent's information to the Department of Revenue. (W.S. 39-18-113, Sec. 1)
Requires nonresident or foreign manufacturers to post a surety bond or cash security of twenty-five thousand dollars payable to the state, which may be executed by the department to cover fines, penalties, and costs of seizure and destruction. (W.S. 39-18-114, Sec. 1)
Directs the Department of Revenue to maintain and publish a public directory of all licensed electronic cigarettes and vapor material products beginning October 1, 2026. Prohibits retail sales of products not listed in the directory beginning January 1, 2027. (W.S. 39-18-115, Sec. 1)
