Establishes a licensing and certification system for electronic cigarette and vapor material manufacturers, prohibits delivery sales of nicotine products, and requires biannual compliance inspections of retailers, distributors, and wholesalers.

• Requires manufacturers of electronic cigarettes and vapor materials sold in Wyoming to obtain an annual manufacturer license and file a certification with the Department of Revenue. (W.S. 39-18-112(a), W.S. 39-18-106(d))
• Specifies certification requirements including manufacturer identity and address, principal place of business, PACT Act registration or exemption statement, U.S. Customs and Border Protection form documentation, and agent for service of process information for nonresident manufacturers. • Sets an annual nonrefundable manufacturer license fee of $1,000 and requires nonresident or foreign manufacturers to maintain a $25,000 deposit or surety bond with the state, which may be executed for penalties and product seizure costs. (W.S. 39-18-112(c), W.S. 39-18-112(d))
• Requires licensed manufacturers to submit biannual attestations to the Department confirming accuracy of prior information or reporting changes, along with copies of U.S. Customs and Border Protection forms from the preceding six months. (W.S. 39-18-112(e))
• Directs the Department of Revenue to maintain and publish a publicly available list of all licensed electronic cigarette and vapor material manufacturers on its website beginning July 1, 2025. (W.S. 39-18-112(g))
• Prohibits the delivery sale of electronic cigarettes and vapor materials to consumers in Wyoming, whether by mail, delivery service, telephone, or internet order. (W.S. 14-3-311(a))
• Defines 'delivery sale' as any sale of a nicotine product where the consumer submits the order by telephone, mail, delivery service, internet, or online method, or where the product is delivered by mail or delivery service regardless of seller location. (W.S. 14-3-301(a)(xii))
• Establishes that electronic cigarettes and vapor materials sold by unlicensed manufacturers constitute contraband goods subject to seizure by the Department or peace officers.
