AN ACT relating to the Wyoming gaming commission; amending the composition, qualifications, salaries, officers, duties and powers of the Wyoming gaming commission; continuing the liaisons to the commission; making conforming amendments; repealing provisions; providing for appointments and terminating terms of existing appointments; providing an appropriation; and providing for an effective date.
Amends the Wyoming Gaming Commission's composition, qualifications, structure, and operational procedures while providing an appropriation for member salaries.
- Establishes the Wyoming Gaming Commission with nine members who must be Wyoming residents for four years and qualified electors. Five members are appointed by the governor with Senate approval, and each must have at least five years of professional experience. At least one member must be an enrolled member of the Northern Arapaho or Eastern Shoshone Indian tribe. (W.S. 11-25-101(a), W.S. 11-25-101(b), Sec. 1)
- Provides that commission members receive annual salaries paid in equal monthly installments and establishes procedures for biennial election of a chairman and deputy chairman from among the membership. (W.S. 11-25-101(c), W.S. 11-25-101(d), Sec. 1)
- Prohibits commission members and their family members from owning or having any personal or private interest in any activity regulated by the commission or in any animal participating in a pari-mutuel event. (W.S. 11-25-101(h), Sec. 1)
- Establishes three ex officio nonvoting liaisons to the commission: one senator appointed by the president of the senate, one representative appointed by the speaker of the house, and one person appointed by the governor. Legislative liaisons serve two-year terms and receive salary, per diem, and mileage when attending commission meetings. (W.S. 11-25-101(j), Sec. 1)
- Authorizes the commission to elect a president and vice-president annually and employ a director with knowledge of pari-mutuel betting and gaming, or an executive secretary, or both. The director may be retained yearly or for the racing season only. (W.S. 11-25-104(a), Sec. 1)
- Specifies meeting requirements including that the commission shall hold meetings at times and places within Wyoming as determined by a majority of members, requires a majority quorum, allows commissioners or hearing officers to conduct investigations and inquiries, requires public record-keeping, and permits legislative liaisons to attend executive sessions. - Modifies fund disposition procedures to require quarterly transfers to the legislative stabilization reserve account of amounts in the pari-mutuel account exceeding one million five hundred thousand dollars and updates authorized signatories for warrants to include the chairman and vice chairman.
