Wyoming prohibits manufacturing, selling, distributing or possessing kratom products with specified criminal penalties and limited exemptions.

AN ACT relating to public health and safety; prohibiting the manufacture, sale, distribution or possession of kratom products; making legislative findings; providing criminal penalties; providing exemptions; requiring rulemaking; making conforming amendments; providing appropriations; providing positions; and providing for effective dates.
Prohibits the manufacture, sale, distribution, and possession of kratom products in Wyoming and establishes criminal penalties for violations.
- Makes legislative findings that the U.S. Drug Enforcement Administration lists kratom as a drug of concern, the FDA has recommended federal scheduling for concentrated kratom alkaloids, a 41-state salmonella outbreak has been linked to kratom products, and emergency medical services and poison control encounters involving kratom are rising. (Section 1)
- Defines kratom, kratom products, concentrated kratom alkaloids, and research institutions for purposes of the Kratom Product Prohibition Act. (W.S. 35-7-2202)
- Prohibits any person from knowingly manufacturing, selling, distributing, or possessing kratom products. (W.S. 35-7-2203)
- Exempts research institutions and law enforcement and forensic laboratories from the kratom product prohibitions. (W.S. 35-7-2204)
- Establishes criminal penalties for violations: first offense is a misdemeanor punishable by up to 6 months imprisonment and/or a fine up to $750; second or subsequent offense is a misdemeanor punishable by up to 1 year imprisonment and/or a fine up to $1,000. Each manufacture, sale, distribution, or possession is a separate offense. (W.S. 35-7-2205)
- Makes kratom products subject to seizure and forfeiture as contraband under existing forfeiture procedures. (W.S. 35-7-2206, W.S. 35-7-1049(a)(ix))
- Amends W.S. 35-7-1049 to include kratom products and all raw materials, equipment, and items used in manufacturing, processing, delivering, importing, or exporting kratom products as subject to forfeiture. (Section 3)
- Appropriates $197,540 to the Department of Agriculture for one full-time employee to test kratom products for the period July 1, 2026 through June 30, 2028. (Section 4(a))
- Appropriates $24,000 to the Department of Agriculture to purchase equipment necessary for testing kratom products for the period July 1, 2026 through June 30, 2028.
